This mostly references orders of living plant material online which we currently do not sell. These terms and conditions should not be considered for contract service jobs.

 

We Respect Your Privacy:

We value your privacy and do not sell your email address to outside companies. By providing us with your contact information, you agree to receive informational emails about your order and specials from Marble Botanics. We refuse to spam. You may opt out of receiving future emails by clicking the “unsubscribe” button on the bottom of any email, no hassle.

 

Marble Botanics Limited Guarantee

We guarantee our plants to be true to type and in healthy condition. Due to the nature of buying plants, you are buying a root system. Slightly damaged leaves are not covered under this warranty. This is a cosmetic issue that does not affect the health of the plant. It's a natural way that plants protect themselves when exposed to heat or darkness. Just trim off any yellow or dried leaves and new foliage should start growing.

 

Shipping:

There are factors that could delay these dates. These are estimates, and we cannot guarantee exact shipping dates. Shipping live products has its challenges and occasionally Mother Nature wields her conditions of death. On rare occasions we have to delay shipping due to severe weather forecasts in your area or ours. This is especially true of tropical plants in the winter. Sometimes the seasons are delayed and plants take longer to reach specifications. Although these types of delays are rare, we try to keep you informed. The health of your plants is our highest concern.

 

Spring Shipping:

Due to the nature of certain cold sensitive plants, it is best to ship them during months with milder temperatures. Spring shipped items are identified on their product page, as well as information on Northern States that ship in spring. If you would like to receive a plant earlier than designated or delay its delivery date, we are happy to schedule what’s most convenient. Just call us at (336) 831-5807.

 

Oh No! My box is damaged!

We guarantee that all orders are carefully packed and shipped to ensure your plant’s survival through transit. It is extremely rare that packages are broken or damaged in transit. If this happens please refuse the damaged package and the delivery carrier will return the damaged box to us for re-shipment.

 

5 Day Rule

It's rare that a problem occurs but it can happen. If your plant arrives in less than healthy condition, you need to notify us within five days so that we can assess the problem and try to save the plant. We can also note your order for future reference in case a complication arises. A photo of the problem greatly helps any claim. Should we determine your plant isn’t salvageable by fault of shipping personnel, or our own we will replace it right away. If that plant is no longer in stock, we will offer you credit equal to its value.

 

If you report a problem within 5 days of plant delivery, Marble Botanics will note the concern in your account and we will offer a 100% store credit.

 

And after 5 days?

If the plant was received in good health and no notice is on file for the first five days Marble Botanics will offer a 50% store credit on the purchase price of the dead plant(s). This one time guarantee is not valid after 45 days past the delivery date.

 

Don’t Make It Harder on You

Please do not plant, display or repot a "poor/damaged" plant thinking you can bring it around and then call us weeks later.  We want to know immediately! We are quality conscious growers and we only list healthy plants. So please send us a picture!

Dead or Alive?

Plants die.  But some may be dormant depending on season. Our goal is to provide you with as much information about your plant as possible to ensure ultimate success. However, we are a direct from grower company so feel free to reach out if you have any questions.

 

Things happen!

We cannot guarantee Mother Nature, mischievous animals, plants shipped out of recommended zones, human damage, extreme weather damage, over watering, drought, insects, disease or poor soil conditions. Plants are living organisms that can die from a hundred different causes beyond our control.  We are expert growers who ensure clean, pest free, healthy plants. Unfortunately we are not a big-box store, who can offer plants at a loss. Plants are our business. We go to great lengths to build mutual trust with our customers and guarantee that any plant we send out is true to its picture and type. If you notice pests on your plants after a marked time in your possession, this is probably a symptom of your environment. Our plants are inspected thoroughly (using loupes) while in stock and again before shipment to prevent the spread or damage by pests.

 

Canceling An Order:

We are so fast with our shipping that canceling an order can be difficult. Requests for cancellation must be made by calling (336) 831-5807 immediately. Canceled orders that have not yet been shipped, but are in the process of being packed and shipped, will be charged a 10% cancellation fee. Once you submit your order and the checkout process is completed, your order is taken from our nursery’s inventory and your credit card is charged immediately. Customers cannot cancel orders through email. If the order has tracking information we will not be able to cancel the order.

 

Returns:

Since plants are perishable items, nursery stock cannot be returned without our permission. In some cases, hard good items (those which are not perishable) may be authorized for return, these include items such as fertilizers, planting mixes, planting kits and pots. Customer will be responsible for all shipping and processing charges. We do not refund shipping cost to customers to return their plants to us. By accepting nursery stock, customer accepts seller’s terms and conditions of sale, which constitute the entire agreement. In no circumstance will our liability be greater than the cost paid for the customer’s order.

Accurate Varieties

Marble Botanics takes great care to properly and correctly label all plant varieties. If your purchase has been mislabeled, with proper proof, it will be replaced with the correct products if obtainable. (Our liability limit is addressed further in TOS).

Fast Fingers?

Did you accidentally order twice? We will do our best to try to catch these on our end  but we need your help. Customers are responsible for contacting Marble Botanics immediately if they have accidentally submitted duplicate orders.

 

Growth Rates:

Plants are like humans. We all grow differently. We cannot guarantee how fast your plants will grow, fruit or flower. All plants are unique, and must be cared for properly in a suitable environment and cared for adequately to ensure success. Your results will be unique and will vary based on temperature, light, moisture, nutrients, root-space, humidity and airflow.

 

Pot Sizes:

Most plants that list the container size reference either the diameter of the container or the industry “trade gallon”. These sizes are smaller than conventional gallon measurements.  Some plants that reference pot size may be removed from the listed container prior to shipping.  Certain plants may be root pruned or have excess dirt removed in order to ensure affordability for you but this is rare. Generally our prices are set for you to receive an exceptional product, true to type, carefully shipped and representative of the image on its listing.

 

So Many Plants. So Much Information!

We cannot provide all the information of every single plant we offer, but we will try to hit the good stuff. We do our best to give you what you need to make your decisions on the right plants for your space. We ask that you do your homework as well, to make sure you have all the information you need before purchasing. There is a lot of conflicting growing information offered from horticultural sources for particular plants, as well as what zone your particular area may be in.

For outdoor growing, the USDA Growing Zone map is a guide, and does not take into consideration microclimates and extreme elevations. Other factors like wind protection, mulching and snow cover can also have an effect. If you have any questions about plant hardiness, contact your local County Agricultural Extension Office. Obviously, do not be confused if we include mature plant pictures in plant descriptions. You will be able to purchase the picture of the plant in the corresponding pot size.

 

Dormant Plants

Some plants are shipped dormant based on the time of year! Don’t worry! Dormant plants often have energy charged up in them waiting to burst into rapid growth as their growing season begins. Wholesale Orders:

We guarantee all plants to arrive in a healthy condition and to be true to described plant variety and Size / Description as agreed to in the signed Purchase Agreement documentation. If applicable, all heights are measured from the soil line to the highest extended branch or foliage. We cannot be responsible for improper handling, planting, exceptional weather or lack of proper maintenance. Wholesale orders and oversize products priced separately from the website are not eligible for advertised discounts, promotions or standard warranty. All prices are subject to change without notice. Any additional terms, if any, will be clearly marked on the Purchase Agreement and signed by the customer before payment is rendered. Any images utilized to describe plant health, quality or size are for representative purposes only and do not reflect the specific plants ordered. All sales are final.

 

Use of Coupons:

Only one promo code is allowed per order. This is a one-time use coupon. There will be no "credit" given to the unused portion of your coupon. This credit cannot be used with any other offers, discounts or coupons. All coupons must be applied at the time of purchase.

 

Governing Law; Dispute Resolution

You agree that all matters relating to your access to or use of the Site, including disputes, will be governed by the laws of the United States and the State of North Carolina without regard to its conflicts of law’s provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Wake County, North Carolina, and waive any objection to such jurisdiction or venue. Marble Botanics (and its affiliates, officers, directors and employees) shall not, in any event, be liable for damages in an amount greater than the original purchase price of the product(s). Should Marble Botanics prevail, it will be entitled to cost and attorney fees.
